TAD UPHOLDS APPEAL AGAINST CERVERA BAN

The arbitration tribunal has rescinded Cádiz CF boss Álvaro Cervera’s four-match ban

Spain’s Administrative Court for Sport (TAD) has upheld Cádiz CF’s appeal against the four-match ban handed by the Spanish Football Federation’s (RFEF) Competition Committee to our head coach, Álvaro Cervera, on 11 November 2020.

According to its ruling, dated 18 February, the TAD does not perceive “the clarity argued by the [RFEF] Appeals Committee relating to the intentionality of the remarks [made by Cervera]”, with the result that it comes down to “a subjective judgement over the intentionality of the appellant not based on the literality of the words used”. That leaves “a reasonable doubt over the intentionality of the remarks made”; in such instances, “the principles of in dubio pro reo and presumption of innocence must take precedence”.

The TAD has therefore moved to rescind the aforementioned suspension, as well as the fine of 601 euros given to Cervera.
